As of 1 July 2009 the legislation for sending e-mail newsletters will change. It will no longer be permitted for companies to add other companies to their mailinglist with out explicit authorisation. Sending commerical e-mail newsletters to private recipients was already not permitted with out authorisation.
Companies can however continue to send newsletters to recipients that were obtained through the sale of a product or service, even if there has been no actual authorisation. The law specifies several conditions; First: the messages must be related to similar products or services. Secondly: there must be an ‘opt out’ link for recipients to unsubscribe.
